Case Summary

Hindu religious sentiments were insulted when a YouTuber made objectionable remarks about the Sant Samaj (Hindu saints), a Hindu religious leader, and Hindu religious institutions. This prompted a complaint to be filed at the Konch police station in Jalaun district, Uttar Pradesh. The complaint was filed on 16 April 2026 by Rambhushan Udainia, District President of the Akhil Bharatiya Hindu Mahasabha, a Hindu organisation, who objected to the video's content and called for strict action. According to the complaint, the accused uploaded a video on social media, making false and derogatory statements targeting Jagatguru Swami Chakrapani Ji Maharaj, a Hindu religious leader, which harmed his personal reputation. The accused also made objectionable statements against the Sant Samaj (the saint community) and traditional Akharas (Hindu religious institutions), resulting in a hostile atmosphere towards them. The organisation further stated that Swami Chakrapani Ji Maharaj had played a prominent role in representing matters related to the Ram Janmabhoomi issue before the Supreme Court and had consistently spoken out against anti-national activities and terrorism, due to which he had previously received death threats and had been provided Z-category security by the central government since 2015. The complaint emphasised that the video fostered a negative perception of Hindu saints while portraying leaders of other religions in a favourable light, and described the content as part of a deliberate attempt to disturb communal harmony. Acting on the complaint, Konch Police Station in-charge Brajesh Bahadur stated that the matter had been taken into cognisance and that an investigation had been initiated to verify the authenticity of the video and the statements made within it. He added that legal action would follow in accordance with the law.

Why it is Hate Crime ?

This case has been added to the tracker under the primary category of - Hate Speech against Hindus. Within it, the sub-category selected is- Anti-Hindu slurs, mocking faith. Anti-Hindu slurs and the deliberate mocking of the Hindu faith owing to religious animosity involve the usage of derogatory terms, stereotypes, or offensive references to religious practices, symbols, or figures. One of the common anti-Hindu slurs used against Hindus is “cow-worshipper” and “cow piss drinker”. The intention of using this term is to demean and mock Hindus as a group and their religious beliefs since Hindus consider the cow holy. Additionally, some symbols and the slurs attached to them have a historical context that exacerbates the insult, hate, stereotyping, dehumanisation and oppression against Hindus. Cow worship has been used for centuries to denigrate Hindus, insult their faith and oppress Hindus specifically as a religious group. There has been overwhelming documentation about how cow slaughter has been used to persecute Hindus with cow meat being thrown in temples and places of worship. There has also been overwhelming documentation where cow meat (beef) has been force-fed to Hindus to either forcefully convert them to Islam or denigrate their faith. Apart from cow worship, the Swastika – which holds deep religious significance for the Hindus – has also been misinterpreted and distorted to use as a slur against Hindus. Similarly, the worship of the Shivling has been used by supremacist ideologies and religions to denigrate Hindus owing to religious animosity. Such slurs and denigration stem out of inherent animosity and hate towards Hindus and their faith, therefore, it is categorised as hate speech targeted at Hindus specifically owing to their religious identity. The other sub-category selected is- Mocking/denigrating Hindu leaders. Hate speech is defined as any speech, gesture, conduct, writing, or display that is prejudicial against a specific individual and/or group of people, which is leading to or may lead to violence, prejudicial action or hate against that individual and/or group. Religious leaders are often seen as representatives of the community, especially, the community’s religious faith and beliefs. Mocking or denigrating a religious leader specifically owing to his religious identity and/or the religious rituals he observes can be considered hate speech because the motivating factor of the speech is animosity and/or dislike for what he represents – the religious beliefs and faith of the community. It is important to note that mere insulting words against an individual do not constitute hate speech. It is entirely possible that insulting words are used for an individual, however, the specific speech is not the result of religious hate and/or animosity towards the professed faith of the religious leader, but the individual himself. For the speech to be considered hate speech, the speech itself or the motivating factor behind the speech has to be religious in nature. Such speech which denigrates Hindu religious leaders specifically owing to animosity towards the faith they profess and the community faith they represent will be treated as hate speech under this category. This case has been added to the tracker because the accused YouTuber made and disseminated objectionable and derogatory remarks targeting the Sant Samaj (the saint community), a Hindu religious leader and Hindu religious institutions. The content directly targeted Jagatguru Swami Chakrapani Ji Maharaj, while also extending disparaging commentary towards the broader Sant Samaj and traditional Akharas, thereby impacting not just an individual but the institutional and spiritual framework associated with Hindu religious practice. The content specifically focused on Jagatguru Swami Chakrapani Ji Maharaj, a prominent Hindu religious leader. As a recognised spiritual figure with an established role in religious and public life, he represents not only his personal identity but also a broader section of the Hindu community that looks to such leaders for guidance and representation. Attacking him in a defamatory and derogatory manner extended beyond individual criticism and assumed the character of an assault on the religious authority and legitimacy he embodies. Such remarks have the effect of eroding trust in religious leadership and fostering hostility towards figures associated with Hindu religious expression. Such acts of the perpetrator are rooted in deep-seated animosity against the Hindu faith and community, making it an anti-Hindu offence. The targeting of the Sant Samaj further amplified the communal impact of the incident. The Sant Samaj represents a collective of Hindu saints and spiritual practitioners who play a vital role in preserving and transmitting religious traditions, values, and practices. Derogatory statements directed at this group amounted to an attack on a core religious community that functions as a custodian of Sanatan Dharma. By portraying the Sant Samaj in a negative and demeaning light, the content contributed to undermining the dignity of an entire group of religious figures, thereby fostering a hostile environment towards those associated with Hindu spiritual life. Additionally, the disparagement of traditional Akharas and Hindu religious institutions reinforced the hate-driven nature of the content. Akharas are longstanding religious bodies that serve as centres of spiritual discipline, learning, and cultural continuity within Hinduism. Targeting such institutions weakened the legitimacy of organised religious structures and disrupted the broader ecosystem that sustains Hindu religious practice. When such remarks are broadcast on public platforms, they not only cause immediate offence but also contribute to the normalisation of disrespect towards Hindu institutions, thereby reinforcing negative narratives about the Hindu faith. The use of social media platforms to circulate the video significantly amplified its impact. By publishing the content on widely accessible platforms such as YouTube, the accused ensured that the remarks reached a broad audience, thereby magnifying the potential harm to religious sentiments. Public dissemination of such content increases the likelihood of normalising disrespectful discourse against Hindu religious figures and institutions, while also fostering an environment of distrust and hostility. Taken together, the deliberate targeting of Hindu religious leaders, the denigration of core religious institutions, the amplification through public platforms, and the creation of a narrative that fosters hostility towards the Hindu community establish clear intent and impact. The incident is rooted in animosity towards Hindu religious identity and contributes to the broader pattern of derogatory discourse against Sanatan Dharma. It therefore meets the threshold of a religiously motivated hate speech case and has been included in the Hinduphobia Tracker's Hate Crime database. Disclaimer: The Hinduphobia Tracker records the dates of incidents based on when the crime occurs rather than when it is reported by the media. In this case, media reports have not stated the exact date when the accused made the derogatory remarks.
