Case Summary
In Barawar town of Lakhimpur Kheri, Uttar Pradesh, the Hindu community and its leaders, like Yogi Adityanath, the Chief Minister of Uttar Pradesh and religious head of Gorakhnath Math, a Shaiva Hindu monastery, were abused with derogatory remarks by a Muslim man. The accused is identified as Surfan, son of Irfan, a resident of the town's Mohalla Prem Nagar. The accused abused the Hindu community, Yogi Adityanath, and Prime Minister Narendra Modi in a Facebook post. As soon as the post went viral on social media, Hindu organisations expressed outrage over the derogatory language used by Surfan. Bajrang Dal activists, recognising the seriousness of the matter, submitted a petition to the Barawar police, demanding strict action against the accused. Upon receiving the complaint, the police administration immediately took action. Barawar outpost in-charge Narendra Kumar Singh, along with his team, raided the area and arrested the accused, Surfan. The police registered a case against him under relevant sections of the Bharatiya Nyaya Sanhita (BNS) and sent him to jail in judicial custody. The police administration appealed to the general public not to share any kind of inflammatory posts on social media, which may affect the law and order of the area.
Why it is Hate Crime ?
This case has been added to the tracker under the primary category- Hate Speech against Hindus. Within this, the subcategory selected is- Anti-Hindu slurs, mocking faith. Anti-Hindu slurs and the deliberate mocking of the Hindu faith owing to religious animosity involve the usage of derogatory terms, stereotypes, or offensive references to religious practices, symbols, or figures. One of the common anti-Hindu slurs used against Hindus is “cow-worshipper” and “cow piss drinker”. The intention of using this term is to demean and mock Hindus as a group and their religious beliefs since Hindus consider the cow holy. Additionally, some symbols and the slurs attached to them have a historical context that exacerbates the insult, hate, stereotyping, dehumanisation and oppression against Hindus. Cow worship has been used for centuries to denigrate Hindus, insult their faith and oppress Hindus specifically as a religious group. There has been overwhelming documentation about how cow slaughter has been used to persecute Hindus with cow meat being thrown in temples and places of worship. There has also been overwhelming documentation where cow meat (beef) has been force-fed to Hindus to either forcefully convert them to Islam or denigrate their faith. Apart from cow worship, the Swastika – which holds deep religious significance for the Hindus – has also been misinterpreted and distorted to use as a slur against Hindus. Similarly, the worship of the Shivling has been used by supremacist ideologies and religions to denigrate Hindus owing to religious animosity. Such slurs and denigration stem out of inherent animosity and hate towards Hindus and their faith, therefore, it is categorised as hate speech targeted at Hindus specifically owing to their religious identity. The other subcategory selected is- Mocking/denigrating Hindu leaders. Hate speech is defined as any speech, gesture, conduct, writing, or display that is prejudicial against a specific individual and/or group of people, which is leading to or may lead to violence, prejudicial action or hate against that individual and/or group. Religious leaders are often seen as representatives of the community, especially, the community’s religious faith and beliefs. Mocking or denigrating a religious leader specifically owing to his religious identity and/or the religious rituals he observes can be considered hate speech because the motivating factor of the speech is animosity and/or dislike for what he represents – the religious beliefs and faith of the community. It is important to note that mere insulting words against an individual do not constitute hate speech. It is entirely possible that insulting words are used for an individual, however, the specific speech is not the result of religious hate and/or animosity towards the professed faith of the religious leader, but the individual himself. For the speech to be considered hate speech, the speech itself or the motivating factor behind the speech has to be religious in nature. Such speech which denigrates Hindu religious leaders specifically owing to animosity towards the faith they profess and the community faith they represent will be treated as hate speech under this category. This case is a clear instance of a religiously motivated hate crime, as the Muslim man abused the Hindu community and Hindu religious leaders like Yogi Adityanath, as well as Hindu political leaders like Narendra Modi, in a Facebook post. The act of abusing the Hindu community as a whole through derogatory remarks and collective vilification showcased the perpetrator's deep-seated religious animosity towards Hinduism and the Hindu faith. Derogatory remarks against an entire religious community, rather than isolated individuals or policy critiques, constitute hate speech by deliberately inciting prejudice, fostering communal division, perpetuating stereotypes, and dehumanising a group solely based on their shared faith and cultural heritage. Such rhetoric poisons social harmony, escalates interfaith tensions, and signals intent to intimidate or subordinate Hindus as second-class citizens. The fact that the perpetrator faced swift arrest by Barawar police under relevant legal sections highlights the post's extreme intensity, blatant derogatory content, and potential to disrupt public order, confirming its classification as religiously motivated hate speech warranting criminal action. The accused also abused Yogi Adityanath, who serves as Chief Minister of Uttar Pradesh and head of Gorakhnath Math, a Shaiva Hindu monastery, making him both a political and religious leader. Considering the broader denigration of the Hindu community, this abuse targeted him not as a politician but as a revered leader of Hinduism. As a saffron-clad monk and religious leader, Yogi Adityanath represents the Hindu faith, its values, and its philosophy. Hindus hold their religious leaders in high esteem, viewing attacks on figures like Yogi Adityanath, who embodies Shaiva traditions, as direct verbal assaults on Hindu religious sentiments. Such targeted denigration amplifies the religious motivation, escalating it to hate speech designed to provoke outrage and erode Hindu dignity. The accused further abused Prime Minister Narendra Modi, who leads the Bharatiya Janata Party, often perceived by Muslims as a Hindu-centric party. Given the overall attack on the Hindu community, Modi was vilified not merely as a politician but as a prominent Hindu political leader symbolising Hindu aspirations. These derogatory remarks against Hindu political figures underscore the perpetrator's animosity towards the entire Hindu community, framing political opposition through a religious lens and solidifying the hate crime nature. Posting all this on a public Facebook platform demonstrated the perpetrator's intent to amplify his message far and wide, maximising hurt to Hindus and their faith identity. Social media's viral reach weaponised the abuse, aiming to inflame tensions, garner support from like-minded individuals, and inflict widespread emotional trauma on the Hindu community. Since this case meets all parameters of a religiously motivated offence, it has been added to the Hinduphobia Tracker's Hate Crime database. Disclaimer: The Hinduphobia Tracker records the dates of incidents based on when the crime occurs rather than when it is reported by the media. In this case, media reports did not state the exact date when the accused made these derogatory remarks. Since the media report was published on 15 March 2026, this date is selected as the indicative incident date. This is recorded for documentation purposes only.
