Muslim man traps Hindu girl and forces her to perform Nikah, assaults her for worshipping Hindu deities while compelling her to observe Ramzan

Case Summary
A 20-year-old Hindu girl undergoing GNM training at Noida’s Yatharth Hospital, was lured by a Muslim man named Mubarak, a resident of Jhenjhpuri village in Deeg, through Facebook. Mubarak trapped her in Rajasthan’s Bharatpur and, on September 1, 2023, took her to an acquaintance’s house in Bela village of Sikri police station area. There, he kept her hostage for 10 days, performed nikah with her, and changed her name to Ayesha. Subsequently, Mubarak took her to his home, where he and his family began assaulting her for worshipping Hindu deities, forcing her to only offer namaz and consume non-vegetarian food. She was compelled to fast during Ramzan, and when she resisted, she was severely beaten. Confined to the house, she had no means of communication. The victim managed to contact her family and inform them about her situation. Upon receiving the distress call, the victim's family rushed to Jhenjhpuri village to rescue her. However, the accused refused to release the girl. Subsequently, the family sought help from the Kaman police station. Both the victim and the accused were taken to the station, where the police interrogated the latter. Eventually, the girl was handed over to her family. The visible marks of assault on her body shocked her family members. It was revealed that the accused had also deprived the victim of the education she was receiving in Noida. Despite the ordeal, no formal complaint was filed against the accused, and he was released after the interrogation.
Why it is Hate Crime ?
In this case, there are two distinct components which prove that the offence was committed coupled with a religious bias. The first factor is that the accused forced the victim to convert to Islam before marriage. The accused did not allow the Hindu victim to practise Hindu rituals instead forced the Hindu woman to follow Islamic practices like fasting on Ramzan and doing Namaz and force-feeding her non-vegetarian food against her will. In such cases, a non-Hindu man is in a relationship with a Hindu woman when the pressure to convert her religion begins to manifest. The relationship in such cases is mostly consensual and the religious identity of the perpetrator is known to the Hindu woman in the relationship, however, at some point during the relationship, the non-Hindu man starts to force the victim to convert her religion and give up her Hindu religious identity. In such cases, the methods used to force the victim to convert her religion often revolve around force-feeding beef, forcing her to wear hijab, forcing her to read the Kalma or even pressurizing the victim to do ‘Niqah’, which is marriage under Islamic law, with a prerequisite being conversion to Islam. Cases where a Hindu woman consensually converts to Islam in a relationship will be left out of the hate crime database, even though it could be argued in several cases that the conversion was a result of religious brainwashing. Secondly, the Muslim perpetrator assaulted the victim when she refused to convert to Islam. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces threats or assault after she refuses to convert and change her religious identity owing to pressure/force by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressurizing the Hindu woman to convert to Islam and upon her refusal, assaults or threatens the victim. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. Cases where the Hindu woman converts to Islam and does not file a complaint about the force or threat, are not considered a part of the hate tracker, even though, it may be argued that the woman was brainwashed or threatened to convert to Islam.
