Case Summary

Durga Roy, a resident of Shantineketan in Bolpur town, Birbhum district, West Bengal, accused local goons of destroying her temple and forcibly occupying her land with the help of the police. In a viral video, she said that the goons vandalised her temple, assaulted her in front of the police, and later arrested her, confiscating her phone and deleting evidence. Roy accused Sheikh Hasan and TMC councillor Chandan Mondal of aiding in the temple demolition. Despite complaints to the SP and Women’s Commission, no action has been taken. Roy said that she was beaten in jail and is now living in fear, restricted to her house. She accused the police of assisting an influential local man, Debabrata Chowdhury, in encroaching on her land. Chowdhury denied the allegations, stating he had not taken anyone's land. Roy demanded justice and emphasised her status as a single mother raising two children.

Hindus believe that not just the Deity but the temple premises itself are sacred to Hindus since Hindus hold the faith that the entire Temple space is an amalgamation of the divine energy of the deity. Given the central significance of Temples in Hindu Dharma, any attack against a Hindu Temple or its peripheral premises is an attack on the faith itself and is born out of animosity towards the faith, of which, the Temple is a central tenet. Any manner of attack against a Temple and/or its premises would therefore be considered a religiously motivated hate crime.
