Muslim youth poses as a Hindu, wears Tilak and Kalava to lure Hindu woman into marriage, force-feeds her beef and makes her do Nikah-Halala with his father

Case Summary
In Bareilly district of Uttar Pradesh, a beauty parlour owner in Karmchari Nagar alleged that one Abid pretended to be a Hindu named Bablu to befriend her. He wore a tilak and Kalava, Hindu traditional symbols, to deceive her into believing that he was a Hindu. The two fell in love and got married in a temple. In December 2018, Abid called the victim to his house on some pretext. He held her hostage and raped her. Abid's family gave the girl the option of converting to Islam. They described the rape and conversion before Nikah as a family tradition. The victim was forcefully converted and given the new Islamic name of Anjum Begum. Reportedly, Abid blackmailed her with her objectionable photos and videos. Abid also put a condition to accept her as his wife only after she did Nikah Halala with his father, Mohammad Raza. Abid's father raped the victim and forcefully fed her beef. She was threatened to be cut into pieces and thrown into the canal if she tried to complain. After four years of being held hostage, raped and assaulted, the victim finally managed to escape and lodge a police complaint. The police registered an FIR against Abid alias Bablu, his brother Arif, mother Munni Begum and sister-in-law Soni under sections including conversion, rape, dowry harassment, assault and intimidation. Abid went absconding since the case was registered and is being searched.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. In this case, a Muslim man pretended to be Hindu and donned Hindu religious symbols to deceive a Hindu woman. He threatened, raped and forced her to perform Islamic rituals with the intention to convert the victim's religion against her will. Further, force-feeding the victim beef for religious conversion has specific religious connotations. The cow is considered sacred in Hinduism and force-feeding the victim beef is a specific desecration of religious faith in order to convert the victim to Islam. Further, the forced performance of Nikah Halala, where she was raped by the 'husband's' father is also a religiously motivated rape of the victim upon her refusal to convert to Islam. Since the religious motive of the crime is evident from the above stated facts, this case has been documented as a hate crime.
