Muslim police constable rapes and forcefully marries Hindu girl, threatens her when she refuses to convert to Islam
Case Summary
A Hindu woman hailing from the Hapur district in Uttar Pradesh accused a Delhi Police Constable named Wasim of intimidation, rape and forced conversion. The Hapur victim lived in a flat in Lajpat Nagar with her family; Wasim and his family lived in the same building. Wasim’s mother Jamila used to talk to her in a very loving manner and frequently shared stories praising Islam. The victim alleged that Jamila once invited her to her home and offered her food which was spiked. After the victim fell unconscious, Wasim raped her. When she regained consciousness, Jamila started pressuring her to get married to Wasim. Upon refusal, the mother-son duo threatened to kill the victim’s brother. Wasim kept sexually exploiting the victim. He also got her raped by his brother. On December 28, 2012, she was forcibly married to Wasim. To save face, the victim's family moved out of the area. Wasim and his family forced the victim to sign various documents and changed her name to Iqra Ahmed. In April 2015, she gave birth to Wasim’s child but the atrocities continued. Wasim force-fed her drugs and had unnatural sex with her. The victim alleged that Wasim’s brother Arif also started raping her at his whim. Whenever she protested, Wasim threatened her. Wasim’s mother also often told the victim, “When our boys lose interest, they chop off Hindu girls." After 11 years of torture, on May 11, Wasim severely beat her and attempted to choke her with the service revolver’s string. The next day, she managed to escape to her grandfather’s house in Hapur, where she filed a complaint against Wasim and his family. The police named Wasim, his mother Jamila, his father Kayum Ali, and brothers Imran, Arif, Azharuddin, and Shahid as the accused based on the victim’s complaint.
Why it is Hate Crime ?
Three distinct elements in this particular case demonstrate that the Muslim perpetrator committed the crime while harbouring a bias against the Hindu faith. The first factor is that the accused was assaulted and threatened to convert to Islam. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces threats or assault after she refuses to convert and change her religious identity owing to pressure/force by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressurizing the Hindu woman to convert to Islam and upon her refusal, assaults or threatens the victim. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. Cases where the Hindu woman converts to Islam and does not file a complaint about the force or threat, are not considered a part of the hate tracker, even though, it may be argued that the woman was brainwashed or threatened to convert to Islam. Secondly, the accused sexually assaulted the Hindu woman for refusing to convert to Islam. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces pressure/threats/violence to convert and change her religious identity by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressuring the Hindu woman to convert. In some of these cases, the association could be non-consensual as well or, the religious identity of the non-Muslim man could be previously unknown to the Hindu victim. As the case may be, in such cases, the non-Hindu man forces himself sexually on the Hindu woman when she refuses his advances and pressures to convert her religion. The rape of the woman is often seen as either a punishment for the woman refusing to convert. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. The third component in this case which makes it a case of religiously motivated hate crime is that the Muslim perpetrator forced the Hindu woman to perform Nikah with him against her will. When Hindu women are in a relationship with non-Hindu men, there are cases where the on-Hindu partner pressurizes the Hindu woman to perform Nikah (Islamic marriage ritual), or forces the woman to do Nikah by force. Nikah is of specific significance as far as forced conversion is concerned since it is an Islamic marriage – more specifically – a marriage contract that has its roots in the Quran. In this contract, it is imperative that both parties adhere to the Islamic faith. Therefore, when a Muslim partner forces a Hindu woman to do Nikah, the element of forced conversion is also an inalienable factor. In these cases, the Muslim spouse forces/pressurizes the Hindu woman to do Nikah with him. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim, however, somewhere along the relationship the pressure to do Nikah is applied by the perpetrator. In many cases, the religious identity of the perpetrator is hidden from the Hindu woman and the pressure is employed by the man after the victim finds out his real religious identity. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes.
