Muslim man poses as Hindu to trap a Hindu married woman, rapes her, forces her to wear burqa and offer namaz

Case Summary
A married woman from Uttar Pradesh was held captive in Ambala, Haryana, for nearly a month and was raped by a Muslim man named Arif Khan who posed as a Hindu named Abhay Mishra. The victim alleged that she received a call from an unknown caller who claimed to be Abhay Mishra. However, the two started to talk and became close. When the woman went to her maternal home in Mirzapur, Arif also reached there. Following this, the accused took the woman to Ambala. The woman got to know the real identity of Arif Khan, which led to a confrontation between the two. After this, Arif held the woman captive for 25 days and raped her during this period. He also filmed the act and used the clip to blackmail the victim. Reportedly, Arif’s sister helped him in his misdeeds. He also forced her to wear a burqa and offer namaz. After nearly a month, the woman found an opportunity to escape from Khan’s captivity in Ambala, and she reached Mirzapur where her husband had filed a missing complaint with the Padari Police Station. Accused Arif also threatened to kill her husband if she did not return to him.
Why it is Hate Crime ?
When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. What gives this case a distinct religious angle is that the Muslim perpetrator actively hid his religion and pretended to be a Hindu to ensure that the victim woman married him. He purposely hid his religion to deceive the Hindu girl. Further, he blackmailed, threatened and forced the Hindu victim to wear hijab and offer Namaz to convert to Islam. Since the religious motive of the crime is evident from these facts, this case has been documented as a hate crime.
