Minor Hindu girl abducted and gang-raped by four Muslim men in Budaun, Uttar Pradesh

Case Summary
Four Muslim men, Israr, Arif, Tasleem and Abrar, kidnapped a minor Hindu girl and gang-raped her in the Budaun area. Before the victim was abducted, her mother was severely beaten and left half-dead. The minor and her mother were going to defecate in their village when the men started following them. When they reached the fields, the perpetrators started teasing the Dalit girl. When her mother protested, she was beaten and became unconscious. They dragged the girl to a deserted area where Israr and his brother-in-law Taslim, raped the girl. The family members came to know about the incident when the girl raised an alarm. The family members, along with the villagers, caught Israr, Arif and Tasleem and handed them over to the police. Arbaaz is absconding, and his search is underway.
Why it is Hate Crime ?
In this case, a minor Hindu girl was targeted and raped by Muslim men. This could potentially be a crime motivated by religious profiling, as it has been observed that in many cases, Muslim perpetrators target Hindu girls due to inherent animosity towards Hindus. It could also be argued that for a Muslim perpetrator, a Muslim girl would likely be more accessible than a Hindu girl. The fact that the perpetrator specifically targeted the Hindu girl suggests religious profiling of the victim. However, it is equally possible that the crime was one of opportunity, where the Hindu girl was simply accessible to the Muslim perpetrator. It is also important to note here that the victim in this case is a minor, thus making any supposed "consent" from her side legally invalid under the Protection of Children from Sexual Offences (POCSO) Act. Minors are immature and emotionally vulnerable to manipulation by perpetrators. Nevertheless, this remains speculative, as the news report, as of now, provides no clear indication of religious motivations. Moreover, neither the victim's family nor the police has made any statements suggesting that the crime was religiously motivated. For this reason, the case has been added to the 'Undecided' database.
