Hindu woman misled by Muslim man who posed as Hindu wearing kalava and tilak, married in Hindu temple
Case Summary
In Darbhanga, Bihar, Mohammad Ibnai, originally from Rasulpur village, deceived a Hindu girl by posing as Aryan Yadav. He lived as a tenant in her house, pretending to be Hindu by wearing a sacred thread (kalava) and applying tilak. He befriended the girl and, under false pretences, convinced her to marry him at the Hariharnath temple in Sonpur in 2019. After marriage, Ibnai's true identity was revealed to the woman. Despite this, they married again under the Special Marriage Act due to the COVID-19 lockdown. The girl supported Ibnaiyan financially and helped with his education. However, after Ibnaiyan secured a job, he and his family expelled the girl from their home. Ibnaiyan then married another Muslim woman on July 1. The girl, now seeking justice, lodged complaints with the women’s police station and the SSP office.
Why it is Hate Crime ?
This case has been listed under the prime category- Hate crimes against women in relationship and sexual crimes. The sub-category chosen here is- Man pretends to be Hindu. Under this three tertiary categories have been selected, namely, Marries as per Hindu rituals, name changed and wears symbols of Hinduism. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. Here, a Muslim man, masquerading as a Hindu by wearing a kalava and tilak, deceitfully married a Hindu woman in a temple. He later remarried her under the Special Marriage Act, only to eventually abandon her for a Muslim woman. This deceptive and manipulative behaviour, which involved concealing his true religious identity, is a clear case of religious hate. By exploiting religious symbols and rituals sacred to Hindus, Ibnain not only betrayed the woman's trust but also showed a profound disrespect for her faith. This act is a deliberate and calculated affront to her religious identity, further reinforcing the pattern of religiously motivated hate and this is why this case has been added to the hate tracker.
