Arshad of Guna pretends to be Bhaiyyu to trap Hindu girl, rapes and assaults her, forces her to convert using explicit videos
Case Summary
In the Guna district of Madhya Pradesh, a Muslim man named Arshad pretended to be "Bhaiyyu" and befriended a 20-year-old girl Hindu girl on social media. He then regularly recorded explicit videos. When his real identity was revealed, he physically assaulted her and forced her to embrace Islam. The victim girl changed two houses during this time to escape his atrocities. On June 22, 2024, she reached the police station along with the workers of Hindu Jagran Manch and registered a case against Arshad under various sections including rape and assault. The woman from Bamori, suffering from severe financial difficulties, moved to Guna to work and support her family. She befriended a man named Bhaiyyu on Instagram in 2022, who later revealed his real name as Arshad. Their relationship turned abusive as he threatened her parents, sexually assaulted her, and recorded obscene videos to blackmail her. He pressured her to convert to Islam, dress in salwar and burqa, and marry him. Despite changing residences multiple times due to his harassment, he continued to abuse her physically and emotionally. She endured his brutality out of fear for her family's safety and potential public disgrace, living in constant torment for over a year and a half. On June 21, the victim learned about the Hindu Jagran Manch and contacted its district coordinator, Advocate Dilip Kumar Rajak, to share her ordeal. Encouraged by Rajak, she reported the perpetrator. Kotwali police station in-charge Anup Bhargav confirmed that an FIR has been lodged, and the investigation is ongoing with further action pending.
Why it is Hate Crime ?
Two distinct elements in this particular case demonstrate that the Muslim perpetrator committed the crime while harbouring a bias against the Hindu faith. First is that the Muslim accused hid his religious identity to trap the Hindu victim. When a non-Hindu man pretends to be a Hindu to deceive a Hindu woman into a relationship, the act is seen as triggered by malafide intentions. In some cases, the woman eventually accepts the man’s original religious identity and converts after the man’s identity is revealed. These cases could be argued as cases of religious brainwashing and a result of the pressure a woman feels after getting into a relationship with a man. The woman, it can be argued, also changed her religious identity because of the stigma she believes she might face if she chooses to walk out of a deceptive relationship. However, for the purpose of documenting hate crimes, the cases in this subcategory are limited to those where there is explicit violence aimed at religious conversion against the wishes of the victim (force-feeding beef, blackmailing with intimate videos, rape on refusal to convert, etc), or if the woman herself complains of the man’s religious deception. In such cases, it is established that the deception of the non-Hindu man had a specific aim of religious conversion or targeting of the victim due to her Hindu religious identity, therefore, making it a religiously motivated hate crime. The second component which makes this case worthy of being documented in the hate tracker is that the Muslim perpetrator assaulted the Hindu victim and forced her to convert to Islam when his identity was revealed. When Hindu women are in a relationship with non-Hindu men, there are cases where the woman faces threats or assault after she refuses to convert and change her religious identity owing to pressure/force by the non-Hindu man. Such relationships may be consensual with the religious identity of the non-Hindu man known to the victim. Somewhere along the relationship, the non-Hindu man starts pressurizing the Hindu woman to convert to Islam and upon her refusal, assaults or threatens the victim. Such cases are driven by specific religious motivations and against the religious identity of the victim and are therefore qualified as hate crimes. Cases where the Hindu woman converts to Islam and does not file a complaint about the force or threat, are not considered a part of the hate tracker, even though, it may be argued that the woman was brainwashed or threatened to convert to Islam. Such actions are not random but are directed specifically at individuals because of their religious affiliation. This targeted violence is a direct expression of hate and intolerance towards the victim's religion. The central aim of the perpetrator in such cases is to disenfranchise the Hindu victim from her professed faith. Other categories applicable to the case are the woman victim forced to wear burqa, raped or sexually assaulted after she found out the perpetrator's real identity, forced to wear a burqa and follow non-Hindu religious practices. Since the central motivation behind the act is religion, this case has been added as a hate crime.
