Muslim man lures Hindu girl on social media, sexually exploits her and gets married in court, then forcefully performs Nikah and converts her
Case Summary
In Jodhpur, Rajasthan, the accused, a resident of Ahmedabad, first married a Hindu girl in court and then pressured her to change her religion after Nikah (Islamic religious ceremony). He even gave her a new name. The authorities are also looking into the charges of rape, deception and forced religious conversion after the victim lodged a complaint. The victim disclosed that she met the perpetrator through social media. They began by liking each other’s Instagram reels and then started chatting on the app. This interaction led to them growing closer and eventually meeting in person. The perpetrator called the victim to meet near Kaylana and the duo went to Machiya Safari Park. He took her to visit his grandmother’s house where he established a physical relationship promising marriage. Afterwards, he regularly sexually violated her. She did not disclose anything to her family as they were from different religions. On June 5, the accused called her to a court and got married to her. A maulvi (Islamic scholar/cleric) also married them in the garden outside the court and changed her name. She returned home and told her family members about her ordeal, after which they took her to the police station on June 7 and filed a complaint.
Why it is Hate Crime ?
The distinct element in this particular case that demonstrates that the Muslim perpetrator committed the crime while harbouring a bias against the Hindu faith is that he forced her to convert to Islam after marriage. In such cases, a non-Hindu man marries a Hindu woman and the force/pressure to convert to Islam begins after marriage. In such cases, the marriage is consensual in most cases and often, there is no element of the man hiding his religious identity. The marriage could be under the Special Marriages Act where neither parties are required to convert their religion for the marriage to be considered legitimate. While the victim in such cases enters matrimony assuming that religious identity is not a barrier, the non-Hindu man starts to pressure the woman to convert to Islam after marriage. In such cases, there is application of force by the perpetrator, including, denial of the woman’s religious rights. Some of the means by which the woman is forced/pressured to convert include force-feeding beef, forced to read the Kalma, forced to wear a hijab, forced for Halala, etc. There are several instances where after marriage, the woman voluntarily converts to Islam. Such cases are often argued to be a result of religious brainwashing, however, for the purpose of documenting religiously motivated hate crimes, in the absence of the victim complaining of forced conversion, such cases do not form a part of the database.
