Muslim man booked for storming into Dalit girl's house in Pratapgarh, stabbing her to death, hurling abuse targeting identity
Case Summary
On June 4, 2024 in Uttar Pradesh's Pratapgarh district, a man named Qadir Musalman stormed into a Dalit family's home and fatally stabbed a girl named Jyoti. The motive is suspected to be a love triangle, as Qadir had been harassing the victim for a long time. The police registered an FIR and started an investigation. The incident happened in the Kotwali City police station area. The victim's father, Nandiram, who lives in Kanshiram Colony, lodged a complaint stating that Qadir had been visiting their house for 1-2 years and worked as a roti maker in hotels. On the day of the incident, while Nandiram was away, Qadir came to their house at 3:30 pm, abused Jyoti with casteist slurs, and attacked her with a knife. Jyoti's younger sister, Pushpa, witnessed the attack and called their father. By the time Nandiram arrived, Jyoti had died from her injuries. The police took Jyoti's body for a post-mortem and have been searching for Qadir, who is currently absconding. Qadir has been booked under Section 302 of the IPC and the SC/ST Act. Reports suggest that Jyoti had separated from her husband four years ago.
Why it is Hate Crime ?
Any sort of physical attack against a Hindu or a group of Hindus, not resulting in death, due to religious motivations of Abrahamics would be included in this category. This would include local communal clashes, attacks due to Abrahamic blasphemy, Hindus crossing through so-called "Muslim areas", refusal to convert, and any other religious supremacy reasons. The cases categorized here should have resulted in the death of a Hindu victim. Since the attack itself is motivated by religious considerations the crime would be considered a hate crime. In cases where the trigger of the violence is not religious, however, the conflict takes on a religious nature during the course of the violence would also be categorized as a hate crime. In this case, the Hindu-Dalit woman was stabbed by Qadir Musalman after harassing the woman for a long time. However, the religious motive and animosity towards the Hindu woman are indicated by the caste slurs that were hurled at her. The witness, the Hindu-Dalit victim's younger sister, elucidated how the victim was abused with caste slurs by Qadir Musalman before he stabbed her to death. It can be argued that a caste-specific slur is aimed at her micro identity of belonging to the Dalit section of the Hindu community and not her Hindu identity itself. However, as far as Abrahamic religions are concerned, the micro identities of caste, region, and language are secondary. It is the religious identity that drives the animosity of the perpetrator against the Hindu victim. In this case, while Qadir hurled caste abuses at the victim, the animosity was driven by his animosity towards Hinduism and Hindus. While the immediate trigger of the violence could be the "love triangle" as mentioned in reports, the fact that caste slurs were hurled at the victim by the perpetrator make it a religiously motivate hate crime against the victim.
