Case Summary

On May 19, Daryapur Police in Ahmedabad arrested two individuals, Farhan and Faisal, for assaulting and threatening Sandeep Patel, a school principal, while he was surveying a madrasa as per a directive from the National Commission for Protection of Child Rights (NCPCR). The incident occurred in the Sultan Maholla area on May 18, during a state-wide survey of madrasas by the Gujarat education department to obtain details regarding the number of students, instructors, apartments, and other amenities. Sandeep Patel, principal of Shruti Higher Secondary School, was attacked by an Islamist mob when he arrived to inspect the madrasa managed by Saiyad Sultan Masjid. The FIR filed at the Dariapur police station details that Patel was following instructions from a superior to take photographs of the madrasa after finding it locked. As he did so, he was confronted and beaten by a group of people, including Farhan and Faisal, who also stole his phone and government documents. Patel reported that despite identifying himself and explaining his government duties, the attackers continued to assault him while bystanders did nothing. Following the attack, he went directly to the police station to file a complaint.

Why it is Hate Crime ?

In this case, the Hindu school principal was on duty and was inspecting the Madrasa - an Islamic school - on the instructions of NCPCR (National Commission for Protection of Child Rights). Madrasas are Islamic schools which impart Islamic education and are often oppressive towards students. They believe in the strict implementation of Islamic law. Several cases have been documented where the NCPCR found gross irregularities in Madrasas. In a 2024 case, the NCPCR submitted in court that the education system in Madrasas is fostering strict implementation of Sharia and extremist literature. With such activities in Madrasas, there are strong suspicions that the Hindu teacher being specifically targeted when they go to inspect the Madrasa is not just driven by the need to protect the secrecy of the activity of the Madrasa, but also driven by religious animosity of a Hindu inspecting the premises. It is suspected that the violence perpetrated by the Muslim mob was motivated by religious sentiments of the mob and the religious identity of the victim. However, since there are no specific indications that the motivation of the mob was specifically driven by the identity of the victim, and it would be different had the identity of the victim would have been different, this case is being categorised as 'undecided'.
