Case Summary

In the Kotkadar area of ​​Bijnor district, Uttar Pradesh, a Hindu youth was harassed and threatened by three Muslim men for being seen in the company of a Muslim girl. According to reports, the Hindu youth, an intermediate student, was returning home from tuition with his classmate, a Muslim girl, who was also his cousin. The two stopped briefly near an under-construction colony in the Kotkadar area when three Muslim men, Aqib, Aavesh, and Arafat, approached them and began harassing them. They snatched the keys and began interrogating the girl, demanding to know why she was travelling with a Hindu boy. Despite her repeated explanations that the Hindu boy was her relative and that they were returning from tuition together, the accused continued to intimidate and humiliate them. They threatened the Hindu boy, asking how he could be seen standing with a Muslim girl. The Muslim men also filmed the ordeal and subsequently uploaded the video on social media, where it quickly went viral. In the footage, the visibly distressed students can be heard pleading with the men and insisting that they knew each other. Seeing the commotion, some bystanders attempted to intervene; however, the accused continued their harassment. Once the video circulated widely online, the Bijnor police acted swiftly, identified the three accused and arrested them. A case was registered under multiple sections of the Indian Penal Code and the Information Technology Act. The Superintendent of Police stated that such conduct disrupts social harmony and that strict action would be taken against those who attempt to take the law into their own hands. The police further emphasised that no one has the right to interfere in personal relationships or harass individuals based on religious prejudice.

To delegitimize the suffering of Hindu women when such sectarian crimes are committed against them, the theory of ‘Bhagwa Love Trap’ was floated by sections of the Muslim community. As this theory gained traction, Muslim mobs started targeting Hindu men who were seen with Muslim women. In several such cases, the Hindu man was assaulted merely for offering to drop a Muslim woman in his vehicle or being friends. The differentiating factor between such cases and legitimate cases of Hindu women being targeted while in a relationship with Muslim men is that there is no sectarian violence, and force/pressure to convert.
