Case Summary

In Unnao district, Uttar Pradesh, a 16-year-old Hindu girl was kidnapped from her home in the Achalganj police station area. The victim’s family reported that a Muslim youth, Jibran, and his associates forcibly abducted their daughter on the night of September 12. Jibran and his group reportedly threatened to kill the family if they were seen in the village or if they complained to the police. The victim's father stated that the accused forced him to place his thumb impression on a blank paper, falsely stating that his daughter was 20 years old. Out of fear, the family left their home and took refuge elsewhere. The family contacted their son in Delhi, who returned and lodged a complaint with the police. The police registered a case four days later, but the girl was not yet found. Despite arresting four suspects, no significant progress was made. The victim’s brother stated similar incidents had occurred in the village, exposing Jibran and others for targeting girls on religious lines. The family pleaded for justice and appealed to Chief Minister Yogi Adityanath to help find their daughter and bring her home safely. Fear and anger gripped the village due to the recurring incidents.

Why it is Hate Crime ?

This case has been added as a religiously motivated hate crime under the prime category- Hate crimes against women in relationships and sexual crimes. Within this, the sub-category selected is- Brainwashed and/or groomed and under this a tertiary category, namely, 'pattern of targeting Hindu minors' has also been chosen, as per case details. In our database, we have not added incidents where women have converted to another religion of their free will and no allegations of forced/involuntary conversion have been made. However, there are certain cases of conversion where the consent itself is a result of the brainwashing or grooming of a minor by the non-Hindu perpetrator trying to victimise a woman for her Hindu religious identity. The phenomenon of grooming points to non-Hindu perpetrators identifying their Hindu victims’ vulnerabilities and exploiting them over months and sometimes years, to extract the supposed ‘consent’ in order to convert their religion. In most cases of grooming, the victims are minors or the grooming started when the victim was a minor. In other cases of grooming, the non-Hindu perpetrator brainwashes and grooms a minor victim to extract their trust and then proceeds to rape them repeatedly with the intent of converting them to their faith. It is pertinent to understand here that when the victim is a minor, the ‘consent’ to convert or enter into a romantic relationship with an adult itself is redundant – addressed by POCSO. While every case of conversion of a minor and incidents of establishing a physical relationship with a minor by an adult is a crime, for the purpose of this database, a case would be considered a hate crime only if there is a distinct religious angle to the grooming. For example, in the UK, if a Hindu minor is targeted by Pakistani grooming gangs, it would be considered a hate crime because the victims are specifically targeted owing to their non-Muslim religious identity with the perpetrators being Muslim. In other cases, if a Hindu minor is brainwashed into entering a physical relationship with the non-Hindu adult perpetrator and the family alleges grooming/brainwashing of the minor to convert her religion, it would form a part of this database. If the victim is a Hindu adult, the case would form a part of this database only if the victim herself says that she was brainwashed/groomed to convert her religion. However, if the victim is deceased (murdered or otherwise), the case would form a part of this database if her family/friends provided testimony that the victim was brainwashed/groomed to convert her religion. Since these crimes have a distinct religious angle where the victim is being targeted owing to her Hindu religious identity, these cases are considered a hate crime. This case, where a 16-year-old Hindu girl was abducted by Jibran and his associates, can be classified as grooming, particularly in light of the victim's brother's testimony. He revealed that similar incidents had occurred in the village, indicating a pattern where Jibran and others were targeting young girls through 'love jihad,' a phenomenon in which Muslim men prey on helpless Hindu women, entice and deceive them, convert them to Islam against their will, torture and rape them, and then either kill or leave them. The brother's testimony suggests that this was not an isolated event, but part of a broader strategy involving deceit and coercion, where girls were lured into relationships or abducted under false pretenses. This systematic targeting of minors, based on their religious identity, demonstrates the predatory nature of the crime. There could be no other reason than an inherent animosity against Hinduism that led them to commit the offence. Further, the religious dimension of the crime became even more apparent when the perpetrators not only abducted the girl but also coerced her father into providing false documentation, falsely claiming she was older than her actual age. They further threatened the family with violence, forcing them to flee the village. These actions highlight the calculated and predatory nature of the crime, which extended beyond the abduction to include intimidation and manipulation to cover up their wrongdoing. Since disrespect for the Hindu religion is the primary purpose behind this incident, this case has been added to the tracker under the following category.
