Case Summary

A Muslim youth, Zakir Ansari from Baghpat, deceived and raped a girl by posing as a Hindu. Zakir made obscene videos of the victim and used them to blackmail her. He then pressured her to convert to Islam and threatened to kill her when she refused. Zakir's sister, brother, and mother are also involved in the crime. On August 24, authorities registered a case and initiated an investigation. In the case from the Jhinjhana police station area of Shamli district, Uttar Pradesh, the Hindu girl filed a detailed police complaint against Zakir Ansari, who initially introduced himself as a Hindu named "Jackie." The girl, a student in the Shahdara area of Delhi, met Zakir during her train commute home. Over time, Zakir approached her on social media and gradually gained her trust. One day, Zakir visited her room in Delhi, bringing food and cold drinks under the pretense of discussing studies. The drinks were drugged, causing her to lose consciousness. While she was unconscious, Zakir sexually assaulted her and recorded videos and photos of the incident. Afterward, he used these recordings to blackmail her into further meetings. Fearing that the videos would be leaked, the girl allowed him to return to her room, where he sexually assaulted her again. During one of these encounters, she accidentally discovered Zakir's real identity through his identity card. After realising she had been deceived, Zakir pressured her into marrying him, threatening to leak the videos if she did not comply. The girl agreed to his demand out of fear. He continued to visit her room, demanding a physical relationship, which led her to block his number. Zakir tracked her down at her coaching centre where he pressured her to convert to Islam and marry him. He threatened to upload her intimate videos online and drive her to commit suicide if she did not comply. He also warned her that the Uttar Pradesh Police could not do anything to stop him. Following these threats, Zakir's siblings, Shakir, Nikhat, and Soni, began calling and messaging her, demanding she convert to Islam and threatening her with violence and death if she refused. The girl left her studies in Delhi and returned to her village in Jhinjhana. Despite this, Zakir continued to pursue her, even visiting her village with a friend. In one instance, he took a relative's phone and used it to call her, saying, “I’m calling from your brother’s number now, but next time I’ll shoot them and take you away.” Zakir also began demanding money from them, using threats to extort them. A female political leader from Baghpat also joined in, threatening the victim and her family on Zakir’s behalf. After months of harassment, the girl and her family finally filed a police complaint. The FIR against Zakir Ansari, his brother Shakir, his sisters Nikhat and Soni, and the politician includes charges under Sections 64(2)(m), 351(3), 308(1), and 123 of the Bharatiya Nyaya Sanhita (BNS), as well as violations of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act.

The use of blackmail to force conversion is a clear demonstration of religious hate, as it targets the victim's religious beliefs and seeks to erase her identity. This case is a glaring example of how deep-seated intolerance can manifest in violent and coercive actions, with the ultimate goal of religious subjugation and domination. The deliberate nature of the deception and the subsequent attempt to force conversion highlights the extent of disdain the accused harboured for the victim's faith. Further, the accused also started threatening the Hindu victim after his identity was revealed. Such actions are not random but are directed specifically at individuals because of their religious affiliation. This targeted violence is a direct expression of hate and intolerance towards the victim's religion, hence this case has been classified as a religious hate crime.
