Mohammad rapes 6-year-old Dalit girl in Araria, Bihar, awarded death sentence by POCSO court
Case Summary
In Araria, Bihar, a six-year-old Dalit girl was brutally raped by Mohammad Major, a 48-year-old man. On December 1, 2021, the victim was playing near her home when Major lured her with water and a container, then dragged her into a field and assaulted her. The girl returned home later that night and told her mother about the ordeal. The victim’s mother filed an FIR in the matter on December 2, 2021. A case was filed under provisions of the Indian Penal Code (IPC), Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, and POCSO Act against the accused. Major was apprehended on December 13 while trying to flee to Nepal. On January 12, 2022, the police presented the charge sheet to the court. The Bihar POCSO court took notice of this on January 20, 2022, and on January 24, 2022, it drafted accusations against the convict. Given the gravity of the act, the court issued its decision within 56 days after the incident. The case, which began in December 2021, concluded in just 56 days. Special judge Shashi Kant Rai labelled the crime as one of the "rarest of rare cases" due to its extreme brutality. Additionally, the court ordered a compensation of ₹10 lakh for the victim.
Why it is Hate Crime ?
In this case, a woman was abducted, raped, and threatened by Muslim perpetrators. It has often been seen that Muslim perpetrators target Hindu women owing to intrinsic animosity towards Hindus, specifically Hindu women. However, due to the lack of concrete indication of a religious motive, this case is being categorized as 'undecided'. If more details emerge, it would be added to the hate crime database.
